Liverpool judgement awaits on Wednesday morning

Judgement on the High Court case involving Royal Bank of Scotland and Liverpool co-owners Tom Hicks and George Gillett will be given on Wednesday morning.

Liverpool fans awaiting news of the decision which is so important to the club's immediate future will discover the ruling at 1030 BST on Wednesday.

However, there is no guarantee that the judge will back one side or the other on Wednesday morning. He could in fact pass no definitive judgement.

The High Court in London has been the scene of intense media attention on Tuesday as the boardroom disputes between Hicks and Gillett, the club's board and RBS have been brought out into the open.

Richard Snowden QC, acting for RBS, accused the two American owners of "breathtaking arrogance" and the bank claimed the pair contradicted the rules of a sales agreement when trying to remove commercial director Ian Ayre and managing director Christian Purslow from the board last week. Hicks and Gillett are opposed to the sale as they stand to lose £144 million.

Ayre and Purslow had joined chairman Martin Broughton in voting to approve the sale of the club to New England Sports Ventures, and if the court finds in favour of the bank and reinstates the board, then the takeover will be free to progress.

Hicks and Gillett admit the sales agreement was breached but argue that they were forced to do so because a "sub-committee" of the board excluded them from the sales agreement and did not consider alternative offers.

It emerged on Tuesday that Singaporean businessman Peter Lim has made a £320 million bid for the club and that American hedge fund Mill Financial has tabled a third offer to pay off all the club's debt and commit £100 million towards a new stadium.

The board has denied claims from Hicks and Gillett that they were left out of the sales agreement, and that it is "besides the mark" that there are two alternative offers as the board are within their rights to accept the bid from NESV.

In a further development, Hicks and Gillett's representative, Paul Girolami QC, told the court that Friday's deadline to repay RBS on October 15 is not applicable and that the two Americans are "locked into an agreement" until November 1 with the bank. This was denied by a QC for RBS, who said the bank "deserves to be repaid £200 million on Friday".

Following the discussions, ESPNsoccernet was told that Liverpool are confident of a positive outcome.

"The mood around the Liverpool Board, RBS and NESP was positive,'' said a source. "There is a feeling that the Judge is fully aware of the urgency needed to sort this out ahead of Friday's deadline and to allow the takeover to go through. That has been the feedback from the lawyers and media alike who were in the courtroom."

London - Tampaknya jalan Liverpool untuk memiliki owner baru masih jauh. Sebab kini proses takeover-nya tengah dibawa ke pengadilan serta Peter Lim, peminat baru asal Singapura, menaikkan tawaran untuk mengakuisisi The Reds.

Mulai Selasa (12/10) sore WIB ini, Dewan Direksi klub, Royal Bank of Scotland (RBS) serta owner lama George Gillet dan Tom Hicks, tengah berada di London untuk mengikuti persidangan mengenai sengketa yang terjadi, menyusul sedang berlangsungnya proses akuisisi oleh New England Sport Ventures (NEVS) sejak pekan lalu.

NEVS, yang memiliki tim baseball Boston Red Sox itu, mengajukan tawaran sebesar 300 juta poundsterling dan telah diterima oleh chairman Liverpool Martin Broughton. Dengan begini utang sebesar 285 kepada RBS bisa langsung dilunaskan oleh NEVS.

Kini yang jadi masalah adalah Gillet dan Hicks tak setuju dengan nilai penawaran yang dinilainya terlalu kecil dan tak mendatangkan keuntungan bagi mereka. Alhasil mereka pun menuntut Broughton dan manajemen klub ke pengadilan demi membatalkan deal dengan NEVS itu, dengan tujuan demi mendapat alternatif tawaran yang lebih tinggi.

Pada persidangan itu wakil duo Amerika Serikat itu mengatakan kesalahan dewan direksi adalah mereka terlalu buru-buru menerima tawaran dari NVES tanpa mempertimbangkan yang lain. Namun board menilai langkah mereka itu sudah tepat karena Broughton ditugaskan sejak April lalu untuk mencari investor baru.

Jika sampai hari Jumat (15/10) mendatang kasus di persidangan ini tidak usai maka Liverpool akan masuk ke administrasi Premier League dan mendapat pengurangan nilai sembilan. Jelas hal ini tidak dimaui oleh para fans dan pemain Liverpool.

Di tengah ketatnya proses jual beli itu datang lagi penawar terbaru dari kawasan Asia Tenggara yaitu Lim yang adalah miliarder asal Singapura. BBC baru saja memberitakan Peter telah menaikkan tawarannya menjadi 360 juta pound dengan rincian 320 juta untuk membeli klub serta menghapus utang RBS. Sisa 40 juta pound digunakan untuk membeli pemain baru.

"Seperti tawaran yang telah diajukan sebelumnya, penawaran yang baru ini dalam bentuk uang tunai dan akan menghapuskan utang sebesar 200 juta pound dari pemilik lama dan telah menyebabkan klub dalam ketidakpastian," tutur juru bicara Lim seperti dilansir Reuters.

Tapi Lim, yang ternyata adalah fans Manchester United, itu harus menunggu hingga persidangan itu usai sebab NEVS telah diakui oleh Premier League sebagai penawar resmi pertama. Jika nantinya dalam persidangan itu RBS dan dewan direksi kalah, maka Lim baru bisa masuk dalam proses takeover ini.

TEMPO Interaktif, London:Masa depan Liverpool bergantung pada keputusan hakim di Pengadilan Tinggi London setelah menggelar kesaksian Selasa waktu setempat terkait prospek penjualan klub Liga Primer Inggris itu oleh NESV.

Royal Bank of Scotland, bank pemberi hutang kepada Liverpool, sedang mencari dukungan di pengadilan untuk mendukung tiga direksi klub melego klub ke NESV dengan nilai 300 juta pound sterling (Rp 4,1 triliun).

Setelah hampir 5 jam berargumen, hakim Christopher Floyd mengatakan akan mengeluarkan pernyataan soal masa depan Liverpool hari ini. Hakim akan menentukan apakah dua anggota direksi Liverpool harus dikembalikan pada posisinya setelahh dipecat pekan lalu oleh Tom Hicks dan George Gillet karena menerima tawaran NESV. Kedua pemilik itu menolak melepas klub lantaran merasa harga yang ditawarkan terlalu murah.

Jika hakim mendukung langkah RBS, penjualan kepada NESV harus dilanjutkan. Jika mendapat penolakan, klub kemungkinan akan dinyatakan bangkrut, dan mendapat pengurangan sembilan nilai di klasemen Liga Primer Inggris.

NESV sendiri mempunyai perjanjian akuisisi dengan Liverpool yang bisa dihentikan oleh kedua pihak pada 1 November. “Setiap orang berharap yang terbaik,” kata John W. Henry, pemilik NESV dalam pesannya kepada Liverpudlian di akun Twitter sebelum sesi pendengaran. “Ada situasi naik dan turun. Saya berharap semuanya bisa selesai dengan cepat, Klub Liverpool bisa maju,” tambah pengusaha yang juga memiliki klub bisbol REd Sox tersebut.

Sesi pendengaran dihadiri Martin Broughton, Christian Purslow maupun HIcks dan Gillet. Beberapa Liverpudlian terlihat hadir di dalam pengadilan dengan menggunakan jersy replika tim dan lusinan lainnya menunggu di luar dengan meneriakkan lagu protes melawan Hicks maupun Gillet.

Tom Hicks and George Gillett are now willing to sell Liverpool.

The Sun says they have promised not to force the club into administration if they win their High Court battle with their rival directors today.

Mr Justice Floyd will rule this morning whether the American duo can legally block the £300million sale to the New England Sports Ventures group.

Hicks and Gillett have been accused of breaching the terms of their £237m loan from the Royal Bank of Scotland by trying to sack Anfield directors Christian Purslow and Ian Ayre last week.

But their legal team admitted to yesterday's hearing they have no chance of meeting Friday's repayment deadline.

Paul Girolami QC said: "The owners, opposed to the outright sale of the club, now accept it is inevitable.

"Even though administration is a technical possibility, there is no reality of that happening."
